Data protection

Based on the legal provisions of the Federal Act on Data Protection (FADP), the Ordinance to the Federal Act on Data Protection (OFADP), the Telecommunications Act (TCA) and other data protection regulations, such as the General Data Protection Regulation of the European Union (hereinafter GDPR), we hereby inform you about our handling of your personal data.

1. Basic information on data processing and legal bases

This privacy policy explains the nature, scope and purpose of the processing of personal data in connection with the functionalities of my website and the services offered on it. It applies regardless of the domains, systems, platforms and devices (e.g. desktop or mobile) used to view the website.


The personal data processed on my website includes only usage data (e.g. the web pages of my online offering visited, interest in my services). The term ‘user’ includes all categories of data subjects.


The personal data processed in the context of a business relationship (in the context of an enquiry or an order) includes inventory data (e.g. names), contract data (e.g. services used, names of companies and persons), usage data (e.g. the websites of my online offer visited, interest in my services) and content data (e.g. entries in the contact form or comments).
They include my business partners, patients, customers, interested parties and other visitors to my website and their online offers.


I process your personal data only in compliance with the relevant data protection regulations. This means that your data will only be processed if I have legal authorisation to do so. This means, in particular, if the data processing is necessary for the provision of my services (e.g. processing of enquiries) or is required by law, consent has been given, as well as on the basis of my legitimate interests (i.e. interest in the analysis, optimisation and economic operation and security of my online offer, in particular in measuring reach, creating profiles for advertising and marketing purposes and collecting access data and using the services of third-party providers).

2. Safety measures

The drclive.ch website is operated on servers of the hosting provider hostpoint.ch. These are located in certified and secure data centres in Switzerland. The connection to the servers is made using SSL encryption (recognisable by the URL beginning with ‘https’ and the green mark in the address bar of your browser). My employees and the service companies commissioned by me have been sworn to secrecy and to comply with data protection regulations.

3. Transfer of data to third parties and third-party providers

We only pass on your personal data if you have expressly consented to this, if there is a legal obligation to do so or if this is necessary to enforce our rights, in particular to enforce claims arising from a contractual relationship. We may also pass on your personal data if this is based on legitimate interests in the economic and effective operation of our business.



In addition, we pass on your data to external service providers if this is necessary to fulfil the contract. These service providers use your data exclusively for order processing and not for any other purposes. We will never sell your personal data to third parties.


If content, tools or other means from other providers (hereinafter jointly referred to as ‘third-party providers’) are used within the scope of this privacy policy and their registered office is located in a third country (i.e. not in Switzerland), it can be assumed that data will be transferred to the countries in which the third-party providers are based. The transfer of data to third countries takes place either if there is an adequate level of data protection, user consent or other legal authorisation.


For certain services, we work together with specialised companies (for example, for the operation of my e-mail infrastructure). For this purpose, we transfer personal data in order to be able to operate this service. Here we take suitable legal precautions and appropriate technical and organisational measures to ensure the protection of personal data in accordance with the relevant statutory provisions.

4. Contact & CRM

When contacting me (via contact form or email), the user's details are processed to handle the contact enquiry and process it. The user's details may be stored in my customer relationship management system (‘CRM system’) or in the personal address books of employees.

5. Collection of usage data

Your personal data is collected and used by us during the use of our websites to the following extent and for the following purposes:

When you visit our website, our servers temporarily store every access in a log file. The following technical data is recorded without any action on your part and stored by us until it is automatically deleted after 190 days at the latest:

  • the IP address of the requesting computer

  • the name of the owner of the IP address range (usually your Internet access provider)

  • the date and time of access

  • the website from which the access was made (referrer URL), if applicable with the search term used

  • the name and URL of the retrieved file

  • the status code (e.g. server/client error)

  • the operating system of your computer

  • the browser you are using (type, version and language)

  • the transmission protocol used (e.g. HTTP/1.1)

  • This data is collected and processed for the purpose of enabling the use of our website (connection establishment), ensuring system security and stability in the long term and enabling the optimisation of our website as well as for internal statistical purposes

In addition, the data is analysed to investigate and defend against attacks on the network infrastructure or other unauthorised or abusive use of the website and, if necessary, used in the context of criminal proceedings to identify and take civil and criminal action against the users concerned.


Log file information is stored for security reasons (e.g. to investigate misuse or fraud) for a maximum period of 190 days and then deleted. Data whose further storage is required for evidentiary purposes is excluded from deletion until the respective incident has been finally clarified.


Finally, when you visit our website, we use cookies and applications that are based on the use of cookies.

Cookies

Google Analytics & Google Adwords

We use the web analysis service Google Analytics for the purpose of designing and continuously optimising our website in line with requirements. In this context, pseudonymised user profiles are created and small text files stored on your computer (‘cookies’) are used. In addition to the aforementioned data, we may receive the following information:

  • Navigation path that a visitor follows on the site

  • Time spent on the website or subpage

  • the subpage on which the website is left

  • the country, region or city from which access is made

  • end device (type, version, colour depth, resolution, width and height of the browser window) and

  • Returning or new visitor

This data is transferred to Google Inc. servers in the USA and stored there. The information is used to analyse the use of the website, to compile reports on website activity and to provide other services relating to website activity and internet usage for the purposes of market research and the needs-based design of this website. This information may also be transferred to third parties if this is required by law or if third parties process this data on our behalf. Under no circumstances will the IP address be associated with other data relating to the user. The IP addresses are anonymised so that they cannot be associated (IP masking).


The user can prevent the installation of cookies by setting the browser software accordingly; however, we would like to point out that in this case not all functions of this website can be used to their full extent.

AdWords Conversion Tracking also uses a cookie to determine performance, which is stored on your computer for up to 30 days after you have clicked on an AdWords advert. The information is limited to the total number of users who first clicked on an advert and were then redirected to a page with a conversion tracking tag. However, you do not receive any information that personally identifies users. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website.

By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

6. Right to information, erasure and rectification

You can request information about your personal data stored by me at any time. A formal request for information must be made in writing and must include proof of identity.


We store personal data that you provide to me for as long as I consider it useful to contact you in relation to the or to fulfil our legal obligations, resolve disputes and enforce our contracts. We will then delete the data in a secure manner. You can also have your data deleted or corrected at any time. This can be done by sending a request by e-mail to cws@ggp.ch. We would like to point out that if your data is deleted, you will not be able to use our services, or not to the full extent.


You can revoke your consent to certain data processing at any time with effect for the future.


Please note that statutory retention periods apply to certain data. This data must be stored by us until the deadline expires. We block these files in our system and use them exclusively to fulfil our legal obligations.
